Ačkoli je ochrana práv zaměstnanců při přechodu práv a povinností z pracovněprávních vztahů jedním ze základních pilířů evropského pracovního práva a je zakotvena rovněž, i když poměrně stručně, v zákoně č. 262/2006 Sb., zákoníku práce 1 , můžeme se i dnes velice často setkat ze strany zaměstnavatelů s naprostou neznalostí a nevědomostí vztahující se k tomuto institutu. Předkládaný článek se zabývá problematikou smlouvy o nájmu bytu a s tím souvisejících otázek, zejména pak materií vztahující se k možnosti ukončení takového právního vztahu ze strany pronajímatele.

U kvalifikačních dohod je nezbytné důsledně rozlišovat, zda se jedná o dohodu o zvýšení kvalifikace, nebo o dohodu o prohloubení kvalifikace. Z § 234 odst. 1 a odst. 2 zákoníku práce jednoznačně vyplývá, že dohodu o zvýšení kvalifikace je možné uzavřít bez ohledu na výši předpokládaných nákladů, které zaměstnavatel na zvýšení kvalifikace zaměstnance vynaloží.

V případě ublížení na zdraví dochází k zásahu do přirozených práv člověka, která jsou chráněna zákonem č. 89/2012 Sb., občanský zákoník (dále jen „občanský zákoník“), kdy se jedná zejména o právo na život, právo na zdraví a právo na důstojnost člověka, jeho čest a soukromí (přirozená práva uvedená a chráněná v první části občanského zákoníku).

Střídavá péče, v současné době velmi diskutované téma, jenž na sebe díky nedávné judikatuře Ústavního soudu, strhlo nemalou pozornost napříč celou veřejností. Na jedné straně vzrůstající naděje otců, na prosazení svého práva podílet se rovnou měrou na péči o své děti, na druhé straně pak obava matek z omezení jejich výlučné péče. Tento dlouhodobě vlekoucí se souboj práv obou rodičů, o to kdo se bude podílet větší měrou na péči a výchově dětí, se tak Ústavní soud pokusil v rámci své nejnovější judikatury jednou pro vždy vyřešit. Není to právo otce a ani právo matky, ve prospěch kterého by měly obecné soudy dle názoru Ústavního soudu rozhodovat, nýbrž primární zájem dítěte, který spočívá v právu dítěte na péči obou rodičů.
