Vstup do manželství není obvykle spojen pouze s propojením rodin, ale rovněž s propojením majetkových sfér obou partnerů. Výraz obvykle je zde užit záměrně, a to z toho důvodu, že zákon č. 89/2012 Sb., občanský zákoník, dnes poměrně široce umožňuje snoubencům i manželům zvolit jiný než zákonný režim společného jmění manželů.

Podle ustanovení § 1115 odst. 1 zákona č. 89/2012 Sb., občanský zákoník, ve znění pozdějších předpisů (dále jen „občanský zákoník“ ), jsou spoluvlastníky osoby, jimž náleží vlastnické právo k věci společně. Ustanovení § 1140 občanského zákoníku pak stanoví, že nikdo nemůže být nucen setrvat ve spoluvlastnictví, přičemž každý ze spoluvlastníků může žádat o své oddělení ze spoluvlastnictví v případě, že předmět spoluvlastnictví lze rozdělit, nebo může žádat o zrušení spoluvlastnictví, avšak nesmí tak činit v nevhodnou dobu nebo jen k újmě některého spoluvlastníka.

Rozhodčí řízení je pro své nesporné výhody spočívající především v jeho rychlosti ve srovnání s civilním soudním procesem stále častěji využívaným nástrojem řešení sporů. Na druhou stranu, věnujeme-li mu bližší pozornost, zjistíme, že jako každý jiný institut má vedle svých výhod i celou řadu nevýhod souvisejících zejména s jeho povahou jednoinstančního řízení. Jednou z nich je případ vydání rozhodčího nálezu, který, ať už částečně nebo zcela, neodpovídá průběhu řízení a důvodným očekáváním účastníků.

Ačkoli je ochrana práv zaměstnanců při přechodu práv a povinností z pracovněprávních vztahů jedním ze základních pilířů evropského pracovního práva a je zakotvena rovněž, i když poměrně stručně, v zákoně č. 262/2006 Sb., zákoníku práce 1 , můžeme se i dnes velice často setkat ze strany zaměstnavatelů s naprostou neznalostí a nevědomostí vztahující se k tomuto institutu. I to je mimo jiné důvodem, proč by této problematice měla být věnována značná pozornost.
