Debt recovery for businesses
We help companies and entrepreneurs recover unpaid debts. We review the supporting documents, due dates and the debtor’s defence. We choose the next steps according to the prospects of recovery and the expected costs.

From an unpaid invoice to a substantiated claim
An invoice records a request for payment, but in a dispute you will usually also need to prove what the parties ordered, what was delivered and when payment was due. We review the contract, orders, handover documents and correspondence. We take account of partial payments, complaints and any set-off defence.
We also assess the debtor’s position. A claim may be legally valid, yet recovery may be limited by a lack of assets or insolvency proceedings. This needs to be considered before incurring further costs.
How debt recovery can proceed
Not every case goes through every stage. If the debtor disputes delivery on substantive grounds or raises a claim of their own, the matter may become a broader commercial dispute. In insolvency, the specific procedure for asserting the claim needs to be assessed in good time.
An instalment agreement must also address missed payments
Instalments may be appropriate if the debtor can repay the debt over time. Simply putting amounts into a payment schedule is not enough. We assess acknowledgement of the debt, security and the procedure if the agreement is breached. The terms should reflect both the debtor’s actual capacity and the creditor’s needs.
What to prepare and how costs are determined
Send us the contract or order, invoices, delivery records, a payment summary and correspondence with the debtor. Include the debtor’s identifying details and all known deadlines. If you have already sent demands or started court proceedings, attach the relevant documents as well.
We agree our legal fees according to the scope of the work. Court fees and other litigation costs may also arise. Any costs awarded by the court may not cover the full agreed legal fee, and even a successful judgment does not itself guarantee payment.
Frequently asked questions about debt recovery
Is it worth pursuing a debt without a written contract?
It may be worthwhile. We assess orders, emails, delivery records and other evidence. The absence of a signed contract does not in itself determine whether a claim exists or can be proved.
Is a letter before action required before filing a claim?
It is generally not a prerequisite for filing a claim. However, it matters for recovery of litigation costs and may lead to payment without court proceedings. Its timing needs to take account of any running deadlines.
What if the debtor disputes the invoice?
We first examine the grounds for the complaint and the contractual terms. A dispute over defects or the scope of delivery requires a different approach from simple late payment of an undisputed amount.
What if the debtor is insolvent?
The status of the proceedings and the procedure for asserting the particular claim need to be checked. Ordinary payment reminders may not protect your rights or preserve the relevant deadlines.
Can you improve our contracts to reduce non-payment?
Yes. As part of our contract services, we assess advance payments, handover procedures, payment terms and suitable security for obligations.
